National Association Memoir Writers Affiliate Program Terms of Service
By signing up to be an Affiliate in the National Association of Memoir Writers Affiliate Program ("Program") you are agreeing to be bound by the following terms and conditions ("Terms of Service").
Please read this entire agreement so you know and understand the program rules.
1. NAMW AFFILIATE AGREEMENT
This agreement provides the terms and conditions for participation in the National Association of Memoir Writers affiliate program. Throughout this agreement, the term "Affiliate" refers to you (the applicant) and NAMW refers to the program owner, the National Association of Memoir Writers.
All NAMW affiliates are independent contractors. Affiliates have no authority to make or accept any offers or representations on our behalf. NAMW may modify any of the terms and conditions within this Agreement at any time and at our sole discretion.
To apply to participate in the NAMW affiliate program, you must submit an application and be approved. Applicants will be notified of their acceptance status as soon as possible after their information is reviewed.
3. TRACKING YOUR AFFILIATION
As an approved affiliate of NAMW, you will be receive a special URL once you become an approved member which will be unique to you and will allow you to be compensated through this program.
Affiliates will receive 30% of the revenue as a commission from orders placed through properly coded Affiliate links (unless noted otherwise for a particular product). Commissions may change at the discretion of NAMW. Affiliates will be notified promptly of any changes in commissions.
For a referral to generate a commission to an affiliate, your referred customer must complete the paid membership sign-up process and remit full payment through our secure order system. Commissions are only paid on sales that are made when the customer clicks through qualified affiliate links, and properly placed and coded links are the sole responsibility of the affiliate.
Affiliates will be compensated via a PayPal account, provided to us when you register. If you change your PayPal email address, you are responsible for notifiying NAMW promptly.
6. PERMITTED USAGE
All sites upon which your affiliate links will be used must have prior approval by NAMW. Your affiliate link may not be used upon sites which violate any of the usual proper Internet activities (examples of prohibited sites include, but are not limited to: spam sites; hate sites; adult sites; and the like).
You are responsible for complying with FTC regulations on advertising, this includes, but is not limited to, Federal Trade Commission 16 CFR Part 255: Guides Concerning the Use of Endorsements and Testimonials in Advertising, which requires, in part, that any connections to advertisers be disclosed on your site.
The term of this Agreement will begin when you accept and will end immediately when terminated by either party. Upon the termination of this Agreement for any reason, all licenses granted hereunder shall immediately terminate.
8. LIMITATION OF LIABILITY
NAMW assumes no liability with respect to this Agreement.
NAMW makes no warranties or representations, implied or express, with respect to this Affiliate Program or any affiliate's potential to earn income from the Affiliate Program. NAMW will not be liable for the consequences of any interruptions or errors in the use of our affiliate links.
If any provisions set forth within this Agreement are determined by a court to be unenforceable, they shall be severed from this Agreement, and the remaining provisions shall remain in full force and effect.
Signing up for the NAMW Affiliate Program means you acknowledge that you have read this agreement and agree to all its terms and conditions.
The failure of the National Association of Memoir Writers to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and the National Association of Memoir Writers and govern your use of the Service, superceding any prior agreements between you and the National Association of Memoir Writers (including, but not limited to, any prior versions of the Terms of Service).
